The death of a taxpayer does not eliminate the need to submit a tax return for that tax year. When an income or estate tax return needs to be filed for a deceased individual, the executor or administrator of the estate can generally prepare the return. The executor of an estate is appointed by the decedent's will. In the event that an executor is not listed, or the named individual is unable to complete the task, the court will assign an administrator who is bound to carry out the responsibilities of the estate. Until the estate is closed, the executor or administrator must timely file all tax returns, as well as abide by all rules.
